COP 16 and COP-MOP 5 (October 2024)
The Conference of the Parties, at its
sixteenth meeting, adopted decision
16/2 on digital sequence information on genetic resources.
With this decision, the COP adopted the modalities for operationalizing the multilateral mechanism for the fair and equitable sharing of benefits from the use of digital sequence information on genetic resources, including a global fund, as set out in the annex to the decision. The COP decided that the global fund will be known as the Cali Fund for the Fair and Equitable Sharing of Benefits from the Use of Digital Sequence Information on Genetic Resources.
The COP also decided to explore possible additional modalities of the multilateral mechanism, including, in the context of paragraph 7 of decision
15/9 and the annex to decision 16/2, to take products and services into account. The COP further decided to explore possible new tools and models, such as databases, for making digital sequence information on genetic resources publicly available and accessible in a transparent and accountable manner to all Parties.
The COP invited Parties, other Governments, indigenous people and local communities, and relevant organizations to submit views on the issues referred to in the paragraphs 3 on possible additional modalities and 4 possible new tools and models (including databases) of the decision and requested the Executive Secretary, subject to the availability of resources, to:
- Synthesize the views submitted;
- Commission a study to examine options for making digital sequence information on genetic resources publicly available and accessible in a transparent and accountable manner;
- Submit the synthesis of views and the study to the Subsidiary Body on Implementation for consideration at its sixth meeting;
- Prepare a study on national and international standards for the identification of the small, medium and large entities referred to in paragraph 3 of the annex to decision 16/2; and
- Commission a study on contribution rates, including implications for revenue generation and economic competitiveness.
The COP requested the Subsidiary Body on Implementation to consider the synthesis of views and the study mentioned in subparagraphs 6 (a) and (b) of the decision and to make recommendations to the Conference of the Parties at its seventeenth meeting on:
- Possible additional modalities for the fair and equitable sharing of benefits from the use of digital sequence information on genetic resources; and
- Possible tools and platforms, such as databases, for making digital sequence information on genetic resources available and accessible in a transparent and accountable manner.
Additionally, the COP established the Ad Hoc Technical Expert Group on Allocation Methodology tasked with offering guidance on the disbursement of the funds from the Cali Fund, in particular to develop an allocation methodology for disbursing funding from the global fund for consideration by the Conference of the Parties at its seventeenth meeting, on the basis of the criteria established in enclosure II.
Further, to support the Conference of the Parties in its role as the governing body of the mechanism, a steering committee was established with the terms of reference and composition provided in enclosure IV, under the guidance of the Conference of the Parties. A secretariat with the functions provided in enclosure V is established to serve the Steering Committee and to support the functioning of the mechanism. The operations of the multilateral mechanism will be financed by the global fund.
Finally, the effectiveness of the multilateral mechanism, including the global fund, will be reviewed by the Conference of the Parties at its eighteenth meeting and at every second subsequent meeting against the principles established in decision 15/9, taking into consideration the factors set out in enclosure VI and a methodology to be adopted by the Conference of the Parties at its seventeenth meeting, noting also the relevance of the global reviews of collective progress in the implementation of the Kunming-Montreal Global Biodiversity Framework due to be conducted for the seventeenth and nineteenth meetings of the Conference of the Parties further to decision 15/6.
Second meeting of the Ad Hoc Open-ended Working Group on Benefit-sharing from the Use of Digital Sequence Information on Genetic Resources (12-16 August 2024)
The Ad Hoc Open-ended Working Group on Benefit-sharing from the Use of Digital Sequence Information on Genetic Resources (established in
decision 15/9) held its
second meeting in Montreal from 12 to 16 August 2024. The main item on its agenda was the further development of the multilateral mechanism for benefit-sharing from the use of DSI on genetic resources, including a global fund. To assist it in that task, the Working Group had before it the possible elements of a multilateral mechanism for benefit-sharing from the use of DSI on genetic resources, including a global fund, as contained in the annex of the report of the first meeting, document
CBD/WGDSI/1/3. It also had before it a synthesis of information for the further development of the mechanism (document
CBD/WGDSI/2/2), containing elements of a draft recommendation to the Conference of the Parties to the Convention.
The executive summary of the studies commissioned pursuant to subparagraphs 22 (b) and (c) of decision 15/9 were made available as document
CBD/WGDSI/2/2/Add.2/Rev.1, while the full studies was made available as document
CBD/WGDSI/2/INF/1.
The report of the Co-Chairs on the outcomes of their informal intersessional activities, including the work of the Informal Advisory Group on Benefit-sharing from the Use of DSI on Genetic Resources, was made available as document
CBD/WGDSI/2/INF/2.
The Working Group was invited to further develop the multilateral mechanism on the basis of the aforementioned documents and to make recommendations to the Conference of the Parties for consideration at its sixteenth meeting. The Working Group also considered the invitation from the Subsidiary Body regarding options for indicators on the sharing of benefits from the use of digital sequence information for possible inclusion in the monitoring framework for the Kunming-Montreal Global Biodiversity Framework.
First meeting of the Ad Hoc Open-ended Working Group on Benefit-sharing from the Use of Digital Sequence Information on Genetic Resources (14-18 November 2023)
The Ad Hoc Open-ended Working Group on Benefit-sharing from the Use of Digital Sequence Information on Genetic Resources (established in
decision 15/9) held its
first meeting in Geneva from 14 to 18 November 2023. The main item on its agenda was the issues for further consideration set out in the annex to decision 15/9. To facilitate the deliberations, the issues were grouped into five clusters:
- Cluster A: Contributions to the fund;
- Cluster B: Disbursement of the funds;
- Cluster C: Non-monetary benefit-sharing;
- Cluster D: Governance;
- Cluster E: Relation to other approaches and systems.
Through its deliberations, the Working Group identified elements on which there is potential convergence and elements on which there is a need for further discussion for each cluster. These ‘possible elements of a multilateral mechanism for benefit-sharing from the use of digital sequence information on genetic resources, including a global fund’ are contained in the annex to the
report of the meeting and are to be used as the basis for further discussions.
The Working Group also agreed to further intersessional work to be carried out during the period between its first and second meetings. This work will be led by the Co-Chairs of the Committee of the Whole that was established by the Working Group during its first meeting. The informal intersessional work includes:
- Information-sharing activities, as needed and as appropriate;
- An informal advisory group;
- Online informal regional consultations facilitated by the Co-Chairs.
The Co-Chairs will prepare a report on the outcomes of the intersessional work.
Submission of views pursuant to decision 15/9 (February-March 2023)
In
decision 15/9, the fifteenth meeting of the Conference of the Parties decided to establish a multilateral mechanism for benefit-sharing from the use of digital sequence information on genetic resources. This included asking Parties, other Governments, indigenous peoples and local communities and relevant organizations submit views on the issues set out in the annex.
